Post-Appellate Decision by the U.S. Court of Appeals: Resolution Procedure

As discussed, after a trial-level decision by the U.S. Tax Court, U.S. District Court, or U.S. Court of Federal Claims, either party may appeal to the appropriate U.S. Court of Appeals. Once a final appellate decision is issued by the U.S. Court of Appeals, the case concludes and triggers the resolution procedures outlined below.
Resolution Procedures
  • Payment of Tax, Penalties, and Interest
    • Where judgment is affirmed against the taxpayer, all assessed tax, civil penalties, and accrued interest should be paid promptly. Interest continues to accrue until satisfaction of the judgment.
    • Penalty abatement may be sought in limited circumstances, including reasonable cause or first-time penalty abatement under IRS administrative policies.
  • Issuance of Refunds
    • Where the taxpayer prevails, the IRS is generally required to issue a refund of taxes and interest previously paid, plus applicable overpayment interest from the date of payment.
    • Refund claims must comply with statutory requirements and are subject to the applicable limitations periods.
